1. General conditions
1.1 This document represents the legal framework concerning the relationship between you and S.C. WICKED MEDIA S.R.L., the company that manages the website www.gmv.design, hereinafter referred to as “WICKED MEDIA”.
S.C. WICKED MEDIA S.R.L. is a Romanian legal entity established under Romanian law, with registered office in Suceava, Theodor Neculuta Street 1 B, with the unique registration code RO24871281, being registered at the Trade Register under no. J33/1851/2008.
Please read the Terms and Conditions for the use in any way of the website accessible at the URL: www.gmv.design. By accessing and visiting the Website, registering an account on the Website and/or purchasing products (“Solutions”), you fully and unconditionally accept these Terms and Conditions. Please read the Terms and Conditions carefully in order to avoid possible undesirable consequences, which you may consider as having a negative impact on the data and/or information provided to S.C. WICKED MEDIA S.R.L., .
1.2 The on-line assistance program available on the website www.gmv.design is: Monday-Friday between 09:00-18:00, Saturday and Sunday – unavailable.

1.4 WICKED MEDIA reserves the right to modify or interrupt, temporarily or permanently, partially or totally, the services made available to users through the website www.gmv.design with or without prior notice, without being liable to users (“Clients”) or to any third party natural or legal person or institution in this regard.
1.5 Customers have permanent access to the terms and conditions of use, in accordance with these Rules, which they may consult throughout the entire duration of the operation of the www.gmv.design website. The customer can freely and unhindered browse the site, use the site, create an account, place an order.
2. Site Content and Terms of Use
2.1 Access is made by accessing the URL address: www.gmv.design.
2.2 By using the website www.gmv.design , the Customer is solely responsible for all activities resulting from its use. He is also responsible for any material, intellectual or electronic damage or any other kind produced by the site, in accordance with the Romanian legislation in force.
2.3 By using our site, the Customer expressly and unequivocally accepts these Rules, in the latest updated version, which is communicated in the “Terms and Conditions” section of the site, existing at the date of account creation and/or use of the content and/or at the date of placing the order.
2.4 The use of the www.gmv.design website and the services offered by it are exclusively intended for persons who have reached the age of 18 and registered legal entities operating in accordance with the laws of Romania, whose representatives are authorized to express legal consent to access, visit or use in any other way the Website and/or the Services.
2.5 By registering an order on the Website, the Customer agrees to the form of communication (telephone or e-mail) by which www.gmv.design conducts its commercial operations.
2.6 The Customer may place orders on the www.gmv.design website, by selecting the desired products and completing the order by making payment by one of the methods expressly indicated. The selection of a product without the completion of the order does not entail the registration of an order, implicitly neither the automatic reservation of the respective product.
2.7 By completing the order, the Customer assumes that all the data provided by him/her, necessary for the purchase process, are correct, complete and true at the date of placing the order.
2.8 Also, the Customer consents to be contacted by any means available / offered by www.gmv.design, in any situation in which WICKED MEDIA S.R.L. deems it necessary to contact him/her, in accordance with the Personal Data Processing Policy of WICKED MEDIA S.R.L.
2.9 WICKED MEDIA S.R.L. may cancel the order placed by the Client, following a simple prior notification addressed to the Client, without any subsequent obligation of either party towards the other or without either party being able to claim damages from the other, in the following cases: (i) non-acceptance of the transaction by the bank issuing the Client’s card, in the case of online payment; (ii) invalidation of the transaction by the card processor approved by www. gmv.design, in the case of online payment and/or (iii) the data provided by the Customer on the website is incomplete and/or incorrect.
2.10 The prices of the products displayed on the www.gmv.design website do not include VAT. The price, payment method and payment term are specified in each order. S.C. WICKED MEDIA S.R.L will issue an invoice to the Client for the delivered products, the Client’s obligation being to provide all the necessary information to issue the invoice in accordance with the legislation in force.
2.11 WICKED MEDIA S.R.L. reserves the right to send you the invoice for the order containing the products sold on the website www.gmv.design, exclusively in electronic format, by adding the invoice to your account or by e-mail, to the e-mail address mentioned by the Client in his account. In the case of online payments, S.C. WICKED MEDIA S.R.L. is/cannot be held responsible for any other additional costs incurred by the Client, such as currency conversion fees applied by the bank issuing the Client’s card, if the currency of issue differs from RON. The Customer is solely responsible for this action.
2.12 The ownership of the products marketed on the website www.gmv.design belongs exclusively to S.C. WICKED MEDIA S.R.L. Being a SaaS product and in order to protect the know-how, the Client does not receive an administrator user. The maximum type of access offered is – editor – shop manager. For various functionalities/modules it is possible, on request, to grant dedicated permissions for them. Websites are hosted exclusively on Wicked Media servers.
2.13 The costs of the products and services offered by WICKED MEDIA S.R.L. through the website www.gmv.design, are displayed on the home page of the website and/or in the “Solutions” section of the main menu and are payable at the exchange rate of the day of payment.
2.14 If the Client wishes to migrate to another solution, WICKED MEDIA S.R.L. shall hand over the products, orders, clients, media files and text content of the website that is the object of the Client’s order and, if both parties agree, shall assist the Client in the migration procedure (e.g.: keep in touch with the technical team implementing the new solution and ensure that this process takes place as quickly and optimally as possible for the Client).
2.15 All the information used to describe the products available on the www.gmv.design website (static/dynamic images/multimedia presentations/etc.) does not represent a contractual obligation for WICKED MEDIA S.R.L., they are used exclusively for presentation purposes.
2.16 The content of the website www.gmv.design may not be used, reproduced, distributed, transmitted or exhibited for purposes other than those expressly provided for by the legislation in force applicable in Romania. The extraction of any information, followed by any use for commercial purposes, which exceeds the scope of private copying regulated by law, or for sale or licensing and without prior written consent of the owners of property rights, constitutes a violation of this Regulation.
2.17 What does the customer get when purchasing the product “presentation website” in the standard price?
a. Presentation website with 4 service pages + homepage, all 5 pages perfectly optimized for search engines, for words relevant to the business approved by the customer following Wicked Media research, in this case Google;
b. Performance tested with Google Page Speed Insights, with result over 90 on mobile and desktop devices;
c. Standard contact/blog/terms and conditions/privacy policy/about us pages;
d. Any extra pages can be made for a fee, at the client’s request, outside the initial agreed delivery time, and the fee is set for the hours of work required to make it, or according to the predefined packages of additional services, available on www.gmv.design;
e. Right to change: ONLY one major change to the website is offered, based strictly on a very clear reason. This modification will be evaluated exclusively by S.C. WICKED MEDIA S.R.L.;
f. The average delivery time specified on www.gmv.design for the creation of the website or online shop runs from the date on which the client provides ALL INFORMATION (correctly completed product file ready to be imported, correctly completed brief, media – photos – video received correctly), and this delivery time refers to the first version ready to be reviewed by the client, not the site in its final version. This delivery time is strictly within the scope of the Wicked Media team. The delivery time may exceed the number of days specified on the website if the number of active projects is increased.
2.18 What does the customer get when purchasing the product “online shop website” in the standard price?
a. Online shop website with 4 category pages + homepage, all 5 pages perfectly optimized for search engines, for words relevant to the business approved by the client after Wicked Media research, in this case Google;
b. Performance tested with Google Page Speed Insights, with result over 90 on mobile and desktop devices;
c. Standard contact/blog pages/terms and conditions/privacy policy/payment methods/delivery methods/about us;
d. Any extra pages can be made for a fee, at the client’s request, outside the initially agreed delivery time, and the fee is set for the hours of work required to make it, or according to the predefined packages of additional services, available on the website www.gmv.design;
e. The right to modifications: ONLY one major modification to the website is offered, based strictly on a very clear reason. This modification will be evaluated exclusively by S.C. WICKED MEDIA S.R.L.;
2.19 Automatic payments
Your card will be debited automatically on the first day of each month. To unsubscribe please go to the “Login” section on www.gmv.design and unsubscribe from the “Cancel subscription” button. From that moment your card attached to your account will no longer be charged. If you change your mind you can reactivate your subscription by clicking on the “Reactivate subscription” button.
3. Warranties and product disclaimers
3.1 Your rights are provided for by the Law no. 449/2003 on the sale of products and associated guarantees – republished and are not affected in any way by these Rules. The natural person customer has the right to unilaterally terminate the contract at a distance, within 14 calendar days from the date of payment, without penalty and without giving any reason, by notifying S.C. WICKED MEDIA S.R.L, in accordance with GEO 34/2014 on consumer rights in contracts concluded with professionals, as well as for the modification and completion of some normative acts.
3.2. In the event that the client wishes to request the termination before the delivery of the product, WICKED MEDIA S.R.L. reserves the right to retain the amount paid in full / in part by the client, at the sole discretion of WICKED MEDIA.
3.3 The return of the money within 15 days from the payment is made under certain conditions in which the buyer has an extremely clear and well-founded reason. Under no circumstances is the return of money accepted for reasons e.g. “I don’t like it”, “it’s wordpress”, “it’s woocomerce” and/or other reasons that do not constitute a breach of an undeliverable promise in the description of the products sold by Wicked Media.
4. Processing of personal data
4.1 Please refer to the sections “Privacy Policy” and “Processing of Personal Data” – www.gmv.design, which are integral parts of these Rules.
5. Final Provisions
5.1 Within the limits of the provisions of this Regulation, S.C. WICKED MEDIA S.R.L. cannot be held responsible for any errors occurring on the www.gmv.design website for any reason, including due to changes, settings, etc., which are not made by the site administrator.
5.2 The Site Administrator www.gmv.design reserves the right to place advertising banners of any kind and/or links on any page of the website, in compliance with the legislation in force. All images on the www.gmv.design website are for presentation purposes only.
5.3 These Rules shall be interpreted in accordance with Romanian law and constitute the sole legal instrument of proof for the resolution of any disputes between the parties. Any disputes arising between WICKED MEDIA S.R.L. as administrator of the website www.gmv.design and the Client shall be settled amicably or, if this is not possible, the disputes shall be settled by the competent Romanian courts at the headquarters of WICKED MEDIA S.R.L..
5.4 None of the parties shall be liable for non-performance of its contractual obligations, if such non-performance is the consequence of a force majeure event, in accordance with the legislation in force.
5.5 Each order accepted by the administrator www.gmv.design, is governed by these Rules in the form published on the website www.gmv.design, at the date of acceptance of the order, and Customers shall check each time the Rules in their updated form, and shall place a new order only if they agree with it.
6. Complaints and complaints
6.1 For complaints or claims related to the products purchased, Customers have at their disposal the complaints form on the website: www.gmv.design. The maximum deadline for resolving complaints or complaints is 30 calendar days from receipt.
6.2 S.C. WICKED MEDIA S.R.L. cannot be held responsible for damages of any kind that the Customer or any third party may suffer as a result of the fulfilment by S.C. WICKED MEDIA S.R.L. of any of its obligations according to the order, nor for damages resulting from improper use of the products after delivery nor for their loss.
6.3. Any notification addressed for the purpose of amicable settlement of disputes, as well as any notice of delay will be valid only in the situation where the customer will address SCPA CUCULIS SI ASOCIATII (at the headquarters in Bucharest, sector 2, Vaselor str., no. 16, ground floor), as conventional representative.
6.4. By creating and using the account, the Client assumes responsibility for maintaining the confidentiality of the account data (user and password) and for managing access to the account and, to the extent permitted by the legislation in force, is responsible for the activity carried out through his account.
6.5 Any attempt to access the Customer’s personal data or to modify the content of the www.gmv.design website or to affect the performance of the server on which our website runs shall be considered an attempt to commit one of the offences provided for by Cap. IV, Title II of the Special Part of the Penal Code.
